Terms of Service

These terms govern the use of the GAIX Flash Report website and services. GAIX is operated by SP&P Company Ltd, a company registered in Malta ("we", "us").
1. The service
GAIX Flash Report provides business intelligence, reporting, and advisory services for hospitality operators. Specific deliverables, pricing, and service levels are agreed with each client in a separate engagement agreement or written proposal, which takes precedence over these general terms.
2. Not financial, accounting, or audit advice
Reports, dashboards, projections, and AI-generated commentary produced by GAIX are management information tools based on figures supplied by you. They are approximate by design ("flash" reporting), are not audited financial statements, and do not constitute financial, accounting, tax, or legal advice. You remain responsible for business decisions made using them and for the accuracy of the figures you submit.
3. Your data
You retain ownership of the operational data you submit. You grant us the right to process it to provide the service. We handle personal data as described in our Privacy Policy. On termination, we will delete or return your data on request, subject to legal retention requirements.
4. Fees
Fees are set out on this website or in your proposal: typically a one-time setup fee and a monthly amount, with additional advisory time charged per hour. Fees are exclusive of VAT unless stated otherwise. We may revise pricing for future periods with reasonable notice.
5. Acceptable use
You may not attempt to gain unauthorised access to the platform, resell access without our written agreement, or use the service for unlawful purposes.
6. Availability and liability
We aim for high availability but do not guarantee uninterrupted service. To the maximum extent permitted by law, our total liability arising from the service in any 12-month period is limited to the fees you paid to us in that period. Nothing in these terms limits liability that cannot be limited under Maltese law.
7. Termination
Monthly engagements may be ended by either party with 30 days' written notice unless agreed otherwise. We may suspend the service for non-payment or material breach.
8. Governing law
These terms are governed by the laws of Malta, and the courts of Malta have exclusive jurisdiction.
